Cambodian Criminal Code provisions on Corruption of Judges

 Cambodia is still in the bad ranking of corruption. According to Corruption Perception Index of Transparency International (https://www.transparency.org/en/countries/cambodia), Cambodian's 2019 corruption ranking was 162/180 with 20/100 of the scores. 

In responding to the above rate, Government of Kingdom of Cambodia set up rules and orders to combat corruption such as Anti-Corruption Law and in the Criminal Code.

Criminal Code of the Kingdom of Cambodia  was adopted on October 12, 2009 and was promulgated on  November 30, 2009. This code aims to provide the limitation of the criminal law, what people should and should not do, and other mechanisms pertaining to the criminal procedure.

 Relevant to the Corruption of Judges, Cambodian Criminal Code provided from Article 517 to 519. 

Article 517 is providing on bribery by judges that "The direct or indirect request or unlawful acceptance of gift, offer, promise or interest by judge to perform and act pertaining to his or her function or to refrain from performing an act pertaining to his or her function, shall be punishable by imprisonment from seven to fifteen years." 

Relating to bribery of judges, which referred to the direct or indirect act of giving a gift, offer, promise or benefit to a judge with the view to obtaining from such a judge the performing/non-performing of an act pertaining to his/ her function, shall be punishable by imprisonment from five to ten years (Article 518).  

According to Article 519, legal entities shall be punishable by a fine from ten million to fifty million Riels and some additional penalties, for committing the crime provided in Article 518 (bribery of judges).
